MONROVIA – Criminal Court “A” at the Temple of Justice has postponed its highly anticipated ruling on a critical motion to suppress evidence and a medical examination report in the ongoing high-profile arson case involving six defendants.

Presiding Judge Roosevelt Z. Willie, initially expected to deliver a decision this week, has rescheduled the ruling for Wednesday, September 24, 2025, at 11:00 a.m.

The motion, filed by defense attorneys, seeks to exclude evidence they claim was obtained illegally by the National Security Agency (NSA). Lawyers argue that the NSA acted beyond its legal authority in collecting materials intended for use at trial, potentially violating the defendants’ rights.

Defendants named in the motion include J. Fonati Koffa, Abu Kamara, Dixon W. Seboe, Jacob C. Debbie, among others. They were indicted by the Montserrado County Grand Jury on multiple serious charges, including:

  • Arson
  • Attempted Murder
  • Criminal Mischief
  • Criminal Conspiracy
  • Criminal Facilitation
  • Release of Destructive Forces
  • Reckless Burning and Explosion
  • Criminal Solicitation
  • Recklessly Endangering Another Person

The ruling carries significant consequences. A decision in favor of the prosecution would allow the contested evidence to be admitted, enabling the trial to proceed. Conversely, a favorable ruling for the defense could exclude key evidence, potentially undermining the state’s case and halting proceedings.

A Notice of Assignment, issued on September 17, 2025, by Clerk of Court Gabriel J. Smith, officially summoned all parties to appear for the final ruling. The notice instructs that copies be served to each party or their legal counsel, with returns filed in the Clerk’s office.

The notice reads in part: “You are hereby commanded to notify the parties and/or their counsels in the above-captioned case to appear before the First Judicial Circuit, Criminal Assizes ‘A’ for Montserrado County, Republic of Liberia, sitting in its August Term A.D. 2025, at the Circuit Court House, Temple of Justice Building, Monrovia, Liberia, on Wednesday, the 24th day of September, A.D. 2025, at the precise hour of 11:00 a.m., for the final ruling on the motion to suppress evidence.”
